Defending a Villa Owner Against Contractor Claims

Background
 

A villa owner approached Matrix Construction Claims Consultants after a dispute arose with the main contractor engaged to construct a private villa and associated external buildings.

The contractor alleged that it had been delayed by design changes, late approvals, additional works and other project constraints. It also claimed entitlement to additional payment and disputed the owner’s position regarding contractual guarantees.

The owner required a detailed technical and contractual defence to respond to the contractor’s claims and establish a clear final account position.

Matrix CCC was approached by the owner to review the contractor’s claim and prepare a structured claim defence.
 

Our work included:

• Reviewing the contract, payment records, correspondence, drawings and site records

• Assessing the actual value of works completed on site

• Reviewing the contractor’s claimed variations and additional works

• Analysing the alleged delay events and supporting evidence

• Reviewing the contractual basis for delay damages and related costs

• Assessing the owner’s position regarding contractual guarantees

• Preparing a final account position and claim defence strategy

Key Issues
 

The defence focused on whether:

• The contractor had properly substantiated its variation claims

• The alleged additional works were instructed, approved and evidenced

• The delay claims were supported by proper programme analysis

• The contractor was responsible for poor progress or delay

• The owner was entitled to delay damages and related costs

• The contractor’s claimed final account reflected the actual works completed

Findings
 

The review found that many of the contractor’s claimed additional works were not adequately supported by proper instructions, approvals, drawings, quantities or contractual evidence.
The contractor’s delay claim was also not sufficiently supported by reliable contemporaneous programme analysis. Only a limited extension of time position was recognised, while the owner’s position in relation to delay damages and additional costs was supported by project records.

The final account review significantly reduced the contractor’s claimed entitlement and supported the owner’s defence position.

Outcome
 

The review assisted the owner in converting a broad contractor claim into a structured, evidence-based final account defence.
 

The assessment clarified:

• The actual value of works completed

• The limited value of substantiated additional works

• The contractor’s remaining entitlement

• The owner’s entitlement to delay damages

• The owner’s position regarding contractual guarantees

• The lack of sufficient evidence for many claimed variations

Lesson Learned
 

In construction disputes, a claim must be supported by evidence, not only assertions.
Approved instructions, proper variation records, updated programmes, signed site records, payment history and clear contractual notices are essential. Without proper evidence, claimed entitlements can be substantially reduced or rejected.
